Beta Service Terms

The "Service" currently provided is a public beta ("Beta Service"). By using our Beta Service, You acknowledge and agree that:

  • The Beta Service is made available for testing, evaluation and feedback purposes only, and may not be fully functional.
  • Features and functionality of the beta service may change, be added to, or removed at any time without notice
  • Service interruptions, downtime, data loss or errors may occur as part of ongoing development and testing. If you require more information on the data we collect, please read our Privacy Policy.
  • The Company makes no promises or guarantees that the Beta Service will meet Your requirements, operate without error, or be available on a continuous basis.
  • Your feedback may be used by the Company to improve the Beta Service and may be incorporated into future versions without any obligation to You.
  • Any content or data submitteed during the Beta period may not be retained when the Beta Service ends or transitions to full release.

By continuing to use the Beta Service, You accept these Beta Service Terms in addition to the general Terms & Conditions.



Interpretation and Definitions

Interpretation

  • Accept responsibility for all activities that occur under your account;
  • Notify us immediately if you suspect your account has been compromised.

We reserve the right to suspend or terminate accounts where registration information is false or in breach of these Terms.

User-Generated Content

This Service allows you to create, post, upload or otherwise submit content including text and images (“User Content”). By submitting User Content, you:

  • Represent and warrant that you own or have the necessary licences, rights and permissions to use and authorize us to use all intellectual property in your User Content;
  • Grant us a worldwide, non‑exclusive, royalty‑free, sublicensable and transferable licence to host, store, use, reproduce, modify, publish, distribute and display your User Content in connection with operating and promoting the Service;
  • Waive any moral rights you may have in your User Content, to the extent permitted by law;
  • Understand that we may remove or disable any User Content that we believe in good faith violates these Terms or is unlawful, without liability to you.

Subscription and Billing

We will offer one or more subscription plans (“Plans”) that provide access to premium features. By choosing a Plan, you agree to:

  • Pay the subscription fees described on our site, plus any applicable local taxes;
  • Authorise us to charge your chosen payment method immediately for all fees and applicable taxes;
  • Automatic Renewal: Unless you cancel at least 24 hours before the end of the current billing period, your subscription will automatically renew under the same Plan and price;
  • Cancellation: You may cancel your subscription at any time via your account settings. Cancellation takes effect at the end of your current billing period and does not entitle you to a prorated refund;
  • Failed Payments: We may suspend or terminate your access if payment fails and you do not provide a valid payment method within 7 days of notice.

Our Intellectual Property

The Service and all original content, features and functionality (excluding User Content) and all trade names logos, and trademarks displayed on the Service (whether registered or unregistered) are the exclusive property or Birch Digital or its licensors, and are protected by UK and international copyright, trademark and other intellectual property laws. All rights reserved.

You may not copy, reproduce, republish, upload, post, transmit, distribute, modify or create derivative works of any of our Content or Marks without our prior written consent.

Feedback

If you submit any ideas, suggestions, or other feedback regarding the Service (“Feedback”), you agree that:

  • We shall own all rights, titles and interests in and to such Feedback, including all intellectual property rights;
  • We may use, implement, modify, publish and distribute the Feedback in any form, media or technology, worldwide, without compensation, attribution or restriction;
  • You have no right to challenge our use of the Feedback or to receive any payment, license or other consideration for such use.

The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.

Upon termination, Your right to use the Service will cease immediately.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Waiver

Translation Interpretation

These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time.
